1. Introduction

These Terms and Conditions govern the use of legal services provided by Adv. Mayur N. Gajbhiye (“we,” “us,” or “our”). By engaging our services, you (“Client”) agree to be bound by these Terms and Conditions. If you do not agree with these terms, please refrain from using our services.

2. Legal Services

We provide legal representation and advice related to divorce and family law matters, including but not limited to:

• Divorce proceedings (contested or uncontested)
• Child custody and visitation
• Spousal support (alimony)
• Property division
• Child support
• Domestic violence cases
• Mediation and settlement negotiations

3. Client Responsibilities

By engaging our services, the Client agrees to:

• Provide accurate, complete, and timely information about their case.
• Respond to inquiries and requests for information promptly.
• Cooperate fully with the legal team in preparing for hearings, meetings, and other legal proceedings.
• Inform us of any changes in circumstances that may affect the case.
• Abide by the legal advice and recommendations provided, unless otherwise advised.

4. Fees and Payment

• Our legal fees are based on an hourly rate or flat fee structure as outlined in the engagement agreement.
• A retainer fee may be required at the beginning of our representation, which will be applied toward the total fees and costs incurred.
• Payment for services must be made in accordance with the payment terms set out in the engagement agreement. Failure to make payments may result in suspension or termination of services.
• We may charge additional fees for court filing fees, expert witness fees, or other expenses incurred in connection with the case.

5. Confidentiality

All information provided by the Client will be kept confidential in accordance with attorney-client privilege, except as required by law or with the Client’s consent. We will not disclose information to third parties without prior consent, unless necessary to provide legal services.

6. Conflict of Interest

Before proceeding with representation, we will conduct a conflict of interest check to ensure that we do not have any conflicting interests that would prevent us from representing the Client. If a conflict of interest is identified, we may decline to represent the Client.

7. Communication

We will communicate with the Client regularly to update them on the status of their case. The Client agrees to provide a valid and reliable method of communication (email, phone, etc.). The Client must inform us of any changes to their contact information.

8. Limitation of Liability

While we will make every effort to provide effective legal services, we do not guarantee specific outcomes. The Client acknowledges that results in legal matters cannot be predicted with certainty. Our liability to the Client for any legal malpractice or negligence is limited to the amount of fees paid for the specific legal services rendered.

9. Termination of Services

The Client may terminate our services at any time by providing written notice. We may terminate our representation if:

• The Client fails to cooperate or communicate.
• The Client fails to pay fees or comply with payment terms.
• A conflict of interest arises.
• The Client requests an action that is illegal or unethical.

10. Dispute Resolution

Any disputes arising from these Terms and Conditions or the legal services provided shall be resolved through mediation, and if necessary, arbitration. The parties agree to negotiate in good faith to resolve any disputes before seeking formal legal action.

11. Governing Law

These Terms and Conditions are governed by the laws of the jurisdiction in which the law firm operates. Any legal action or proceeding shall be conducted in the courts of that jurisdiction.

12. Amendments

We reserve the right to amend these Terms and Conditions at any time. Clients will be notified of any significant changes, and continued use of our services will constitute acceptance of the updated terms.

13. Acknowledgment

By signing the engagement agreement or otherwise engaging our services, the Client acknowledges that they have read, understood, and agreed to these Terms and Conditions.
